Aboveground Storage Tanks (AGTs) and Underground Storage Tanks (USTs) are regulated by federal and state laws designed to protect the environment. USTs are a special concern since they are not easily accessed for inspection and many unprotected tanks leak toxic substances into the soil and groundwater. Federal standards for the design and upkeep of USTs were mandated by the Solid and Hazardous Waste Amendments of 1984 and became effective on December 22, 1988 (40 CFR Part 280). In addition to the federal and state laws, tank owners and operators must comply with local ordinances, fire and building codes, and insurance guidelines when installing, removing and/or operating a UST system. The UST laws apply to any tank system (including piping) that has at least 10% of its volume underground and contains a regulated substance. Regulated substances include PETROLEUM PRODUCTS and HAZARDOUS SUBSTANCES (as defined in the Comprehensive Environmental Response Compensation and Liability Act or CERCLA).
